The McKinney-Vento Homeless Education Assistance Act defines homeless children and youth as individuals who lack a fixed, regular, and adequate nighttime residence, including those who:
Share housing with other persons due to loss of housing, economic hardship, or a similar reason (sometimes referred to as doubled up).
- Live in motels, hotels, emergency or transitional shelters, campgrounds, or trailer parks.
- Live in a car, park, abandoned building, substandard housing, or other place not designed as a regular living accommodation.
- Are unaccompanied youth or youth abandoned in hospital or awaiting foster placement.
- Migrant children living in circumstances described above.
